The present study analyzes jurisprudential and legal responsibilities for environmental protection using a qualitative method of documentary content analysis and a comparative examination of jurisprudential sources, domestic legislation, and principles of international law. In response to escalating environmental crises, a fundamental question arises as to how the capacities of jurisprudential and legal systems can be employed to develop an effective framework supported by enforceable mechanisms. The findings indicate fundamental convergence between jurisprudential principles and legal norms. The precautionary principle is closely aligned with the lā ḍarar rule, the theory of strict liability with
the itlāf rule, and the principles of sustainable development and intergenerational justice with the prohibition of extravagance (isrāf). At the same time, important distinctions can be identified, particularly with respect to the source of legitimacy (divine versus contractual), the scope of application (the individual religious duty of Muslims versus general obligations imposed on citizens), and mechanisms for compensation (restitution in jurisprudence versus concepts such as restoration costs and ecological damage in modern law). The principal novelty of the study is the development of an operational framework at three levels. At the legislative level, it proposes translating general jurisprudential principles into specific legal provisions and establishing integrated regulatory institutions. At the judicial level, it proposes applying jurisprudential principles as a basis for interpreting legislation and addressing legal gaps. At the implementation and public-awareness level, it proposes articulating the environmental dimensions of religious rulings as an internal motivating force complementary to legal enforcement mechanisms. The desirable approach to environmental governance is to integrate the insights of the two systems, potentially leading to a sustainable system that benefits both from a strong ethical foundation and from legal and institutional effectiveness. The proposed integrated framework has the capacity to transform religious ethical requirements into legally binding obligations and may provide an indigenous model for green governance in Muslim societies. The study also emphasizes the need for interdisciplinary institution-building at the intersection of Islamic jurisprudence and environmental law and proposes solutions for addressing existing implementation and judicial challenges.
