One type of injury inflicted on a bone is the creation of a cavity within it. This occurs when a sharp and narrow object—such as a screw or a small bullet—penetrates the bone without causing it to fracture. Several narrations specify the amount of diyah (blood money) for this type of injury in different parts of the body. Imamiyyah jurists, following these narrations, have discussed the diyah for this type of injury in certain cases. However, these discussions are scattered and have not been formulated into a general rule. Article 569 of the Islamic Penal Code addresses the general rules concerning bone injuries and, in paragraph (t), specifically refers to this type of injury and its compensation. This study, using a descriptive-analytical method, aims to discover and extract a general principle regarding the amount of diyah for creating a cavity in the bone. It investigates the relevant evidence and sources for diyah of naqibah and evaluates the validity and accuracy of paragraph (t) of Article 569. The findings indicate that, according to reliable narrations, the amount of diyah for the naqibah injury—except in exceptional cases—is systematically and consistently set at one-fourth of the diyah for the fracture of the same bone.
