Discourse Analysis; A New Approach in the Jurisprudence of Jihad from the Perspective of Islamic Scholars and Thinkers

Abstract

Discourse studies analyze the emergence and formation of a thought within a society and how it influences the direction of ideas. Islamic Jurisprudence (Fiqh), as an ancient science, has always impacted the lives of believers within society, and it has been confronted with numerous discourses both internally and externally. In the contemporary world, with the rise of philosophical and rational approaches to jurisprudential rulings, discourse analysis in jurisprudence has become essential. In this research, Islamic jihad, as an important jurisprudential institution, which in the recent century has faced multiple interpretations, is selected. Each interpretation, which is shaped around one or more specific discourses, is analyzed to uncover the roots of each interpretation. This analysis, due to its comprehensive and philosophical perspective, avoids being narrowly focused and aims to reach the correct interpretation of jihad that meets the needs of the time. Interpretations based on the discourses of text, defense, exclusivity, rights, power, and the objectives of Sharia are identified. After being independently explained, these interpretations are synthesized, with particular attention given to the interpretation based on the discourse of objectives.
