A New Perspective on the Production and Use of Weapons of Mass Destruction in States of Necessity from the Viewpoint of Imamiyyah Jurisprudence (A Critical Analysis of Evidence with a Social and Governmental Approach to Jurisprudence)

Abstract

Despite Islam’s strong emphasis on justice and peace, it places great importance on society and considers both individual and social aspects in the establishment of justice. Since the realization of social justice requires both law and authority, Islamic teachings also pay special attention to these dimensions. This study examines the concept of desirable social authority from an Islamic perspective and, given the extensive military threats posed by global powers against the Islamic community, explores whether, in a state of necessity—where an enemy uses weapons of mass destruction—producing, stockpiling, and using such weapons for deterrence, retaliation, halting aggression, and maintaining societal stability is permissible. Employing conceptual, propositional, and systemic analysis, this research reaches a conclusion differing from previous studies, arguing that Islamic legal evidence indicates the permissibility of using such weapons in cases of necessity. Consequently, the production and stockpiling of these weapons for the aforementioned purposes are deemed permissible.
