In addition, according to Article 691, a religious guarantee for which the cause has not yet been clarified is void. It is stated from the above-mentioned articles that according to the legislator, the subject of the contract should be transferable to another person, which means that it must be general. As a result, it is not possible to guarantee a contract in the realm of material property due to its externality and partiality, as well as its irrevocability. The terms of the Civil Code are ambiguous in this regard, because on the one hand, it has chosen to transfer the liability and on the other hand, in Article 697, it has accepted the guarantee of responsibility, part of which is the guarantee of rejection of the material property. There is no common law that is decisive in the dispute, the dispute in jurisprudence has not been resolved, and the religious texts have not written anything about it. However, according to Article 167 of the Constitution of Iran, the ruling on the issue must be determined based on jurisprudential criteria. Therefore, the issue of the present study is whether, according to the rules of jurisprudential-legal principles, it is possible to guarantee a contract of guaranteed property. That is, whether there is a possibility of development in the concept of guarantee or not. The conclusion is that based on the jurisprudential-legal rules and principles, it is not necessary that the subject of the guarantee of the contract be general, so there is no problem to guarantee the material property.}, keywords = {Guarantee,material property,responsibility,liability,Religion}, title_fa = {امکان‌سنجی ضمانت از اعیان خارجی در فقه و حقوق ایران}, abstract_fa = {عقد ضمان در ماده ۶۸۴ ق.م، به‌عهده‌گرفتن مال در ذمه دیگری تعریف شده، و بر اساس ماده ۶۹۸، ضمان موجب نقل ذمه است و همچنین به‌موجب ماده ۶۹۱، ضمانِ دینی که هنوز سبب آن ایجاد نشده، باطل است. از مجموعه مواد مذکور استظهار شده است که به‌نظر قانون‌گذار، موضوع عقد باید قابلیت انتقال به ذمه را داشته باشد؛ یعنی دین و کلی باشد. در نتیجه، ضمان عقدی در حوزه اعیان به‌جهت خارجی و جزیی‌بودن، و همچنین غیرقابل‌تعلق‌بودن به ذمه، امکان‌پذیر نیست. مفاد قانون مدنی در این خصوص مبهم است، زیرا از یک طرف نقل ذمه را انتخاب کرده و از طرفی در ماده ۶۹۷، ضمان عهده را پذیرفته که قسمی از آن ضمانت به رد عین است. عرف مسلّم هم وجود ندارد که قاطع اختلاف باشد، اختلاف در فقه نیز حل نشده است، و نصوص شرعی هم ساکت است. با این حال طبق اصل ۱۶۷ قانون اساسی، بایسته است که حکم مسئله بر اساس موازین فقهی مشخص گردد. بنابراین مسئله پژوهش حاضر آن است که آیا طبق قواعد فقهی-حقوقی، امکان ضمانت عقدی از اعیان مضمونه وجود دارد یا نه؛ یعنی آیا امکان توسعه در مفهوم ضمان وجود دارد یا خیر. نتیجه آنکه مبتنی بر قواعد و اصول فقهی-حقوقی، ضرورتی ندارد که موضوع عقد ضمان، دین و کلی باشد، لذا ضمانت از عین خارجی و جزئی بلااشکال است.}, keywords_fa = {ضمان,اعیان خارجی,عهده,ذمه,دین}, url = {https://jf.isca.ac.ir/article_70523.html}, eprint = {https://jf.isca.ac.ir/article_70523_1330b7833b6199ce8ae2f8321b24afdb.pdf} }
