However, in some cases of electronic sale, verbal or written demand and acceptance is not used and instead, the transfers are done without exchanging and only by selecting a part such as "Send to cart" or "Order registration" and sometimes by clicking on the picture. As a result, the validity and necessity of electronic sale without the occurrence of exchanging and without the usual demand and acceptance, is questioned and the prevalence of electronic sale has caused public demand and the need for a jurisprudential answer to this question. In order to answer the above question, and to prove the need for the composition of the sale without exchanging - using the jurisprudential method - this paper has examined the verbal arguments for demand and acceptance and based on the results of electronic data in electronic sale, it has been concluded that the need for jurisprudential arguments is the validity of the conclusion of sale with any customary implication, even non-verbal. Therefore, the contract of sale is concluded using electronic data - if they indicate the occurrence of the sale and Article 340 of the Civil Code needs to be amended and it should be noted that the demand and acceptance with any argument of the sale - both verbal and non-verbal - is sufficient.}, keywords = {Electronic contract,electronic sale,demand and acceptance,contract writing,contract form}, title_fa = {بررسی فقهی انشای بیع الکترونیکی بدون الفاظ ایجاب و قبول}, abstract_fa = {مطابق نظر فقها و بر اساس مواد قانونی، برای انعقاد بیع، وجود انشای فعلی یا انشای لفظی لازم است و طبق مادهٔ 340 قانون مدنی، باید الفاظ و عبارات ایجاب و قبولْ صریح در معنای بیع باشند. این همه در حالی است که در مواردی از بیع الکترونیکی، از ایجاب و قبول لفظی یا کتبی استفاده نمی‌شود و بلکه نقل و انتقال، بدون انجام داد و ستد و تنها با انتخاب قسمتی مثل «ارسال به سبد خرید» یا «ثبت سفارش» و گاهی با کلیک‌کردن بر روی تصویر انجام می‌گیرد. در نتیجه، صحت و لزوم بیع الکترونیکی بدون وقوع داد و ستد و بدون ایجاب و قبول متعارف، مورد سؤال واقع می‌شود و رواج بیع الکترونیکی موجب مطالبهٔ عمومی و ضرورت پاسخ فقهی به این سؤال شده است. این مقاله در پاسخ به سؤال فوق برای اثبات میزان نیاز به لفظ در انشای بیع بدون داد و ستد - با استفاده از روش فقهی - ادلّه لفظی‌بودن ایجاب و قبول را بررسی کرده و با تطبیق نتیجه بر داده‌های الکترونیکی در بیع الکترونیکی به این نتیجه رسیده است که مقتضای ادلّهٔ فقهی صحت عقد بیع با هر گونه دلالت‌گر عرفی حتی غیرلفظی است. از این‌رو، عقد بیع با استفاده از داده‌های الکترونیکی - در صورتی که دلالت بر وقوع بیع داشته باشند - منعقد می‌شود و لازم است مادهٔ 340 قانون مدنی اصلاح شود و عنوان شود که ایجاب و قبول با داشتن هر گونه دلالت‌کننده بر انجام بیع - اعم از لفظ و غیر لفظ - کافی است.}, keywords_fa = {قرارداد الکترونیکی‌‌,بیع الکترونیکی‌‌,ایجاب و قبول‌‌,انشای عقد‌‌,صیغهٔ عقد}, url = {https://jf.isca.ac.ir/article_69237.html}, eprint = {https://jf.isca.ac.ir/article_69237_251b62f5e6a56d6cbc3eb3d3aa31c3e6.pdf} }
