In the face of this phenomenon, Islam has also identified mechanisms. A glimpse at the jurisprudential rulings indicates that two sets of laws and regulations have been put in place to limit and eliminate poverty: One category is mandatory and obligatory (such as khums and zakat) and the second is the preferential and charitable (Mustahab) one and includes institutions such as donation, charity, waqf (endowment), and loan. The purpose of many principles of jurisprudence is the purpose of its mandatory rulings. Therefore, considering preferential rulings along with the mandatory ones can lead to the simultaneous realization of Shari'ah's goal of making these rulings. Thus, it seems that using the enormous capacity of jurisprudential preferential rulings related to poverty and enforcing them, along with other mandatory and obligatory rulings, can lead to poverty elimination. Analyzing and examining this issue is the subject of this paper and accordingly - after examining the concept of poverty and the criteria for its diagnosis - the issue of donation and charity is dealt with and the final part of the paper is devoted to the study of waqf and loan.}, keywords = {jurisprudence,poverty,preferential rulings,donation,charity,endowment,loan}, title_fa = {ظرفیت‌های احکام ترجیحیِ فقه در مواجهه با مشکل فقر}, abstract_fa = {در چگونگی مواجهه با مشکل فقر و برون‌رفت از آن‌‌، ادیان الهی و مکاتب بشری هرکدام راه‏هایی فراروی بشر نهاده‏اند. اسلام نیز در مواجهه با این پدیده‌‌، سازوکارهایی را به‌رسمیت شناخته است. نگاهی به احکام فقهی بیانگر آن است که دو دسته احکام و مقررات برای محدودکردن و ازبین‌‌بردن فقر وضع شده است: یک دسته احکام واجب و الزامی‌اند (مانند خمس و زکات) و دسته دوم که موضوع این مقاله است‌‌، احکام ترجیحی و استحبابی هستند و شامل نهادهایی همچون انفاق‌‌، صدقه‌‌، وقف و قرض‌الحسنه می‌شوند. هدف بسیاری از قواعد ترجیحی فقه در زمرۀ اهداف احکام الزامیِ آن است؛ پس توجه به احکام ترجیحی در کنار احکام الزامی می‌تواند تحقّق هم‌زمان هدف شارع از تشریع این احکام را به‌دنبال داشته باشد. ازاین‌رو‌‌، به‌نظر می‌رسد استفاده از ظرفیت عظیم احکام ترجیحی فقهیِ مرتبط با فقر و به‌فعلیت‌رساندن آنها‌‌، در کنار دیگر احکام واجب و الزامی‌‌، می‌تواند به ریشه‌کنی فقر بینجامد. تحلیل و بررسی این مسئله، موضوع این مقاله است و بر این اساس ـ پس از بررسی مفهوم فقر و معیار تشخیص آن ـ به موضوع انفاق و صدقه پرداخته شده و بخش پایانی مقاله نیز به بررسی وقف و قرض‌الحسنه اختصاص یافته است.}, keywords_fa = {فقه‌‌,فقر‌‌,احکام ترجیحی‌‌,انفاق‌‌,صدقه‌‌,وقف‌‌,قرض‌الحسنه}, url = {https://jf.isca.ac.ir/article_68446.html}, eprint = {https://jf.isca.ac.ir/article_68446_5268efa1dc067dd4f1de37bdd65dca16.pdf} }
