One of the questions in the judicial debates is that whether a rightful can receive his or her right without bringing an action in the court while the debtor does not know his complaint. The debate set forth as "taqas" (retaliatory act) in Fiqh (Islamic jurisprudence) is for replying to the mentioned question. According to the Quranic and narrative evidences, the principle of permissibility of taqas is an accepted precept, but it has some different forms, and a common and general rule may not be issued in this regard, and the Muslim jurists disagree on some problems of it.  Considering a taqas rule, there are some questions to which paid attention by the Muslim jurists and followed by a number of details and restrictions but they are beyond our discussion. However, a crucial question is also that whether a right can be absolutely received from the property of government or the public goods or even  without initiating the proceedings as it might be understood according to the generality of the Islamic evidences and fatawa    ) opinions of the competent jurists( and absence of any restrictions on them. What should we do where  the authority of the Muslim government and state is disordered and damaged by the mentioned action?     }, keywords = {taqas,rightful,property of state,initiating an action}, title_fa = {تقاص در اموال دولتی و عمومی}, abstract_fa = {یکی از پرسش‌ها در مباحث قضا این است که آیا صاحب حق می‌تواند بدون طرح دعوا نزد دادگاه، هر چند بدون آگاهی بدهکار، به استیفای حق خود بپردازد؟ آنچه در فقه با عنوان «تقاص» مطرح شده، در پاسخ به همین پرسش است. در بررسی حکم تقاص،  یک پرسش مهم این است که آیا آن‌گونه که از اطلاق و عموم ادله و فتاوا برمی‌آید، می‌توان به صورت مطلق یا در شرایطی، بدون رجوع به دادگاه، شخصاً به استیفای حق خود از اموال دولت یا عمومی اقدام کرد؟ در صورت کشیده‌شدن به هرج و مرج و خدشه به جایگاه حکومت و دولت اسلامی چه باید کرد؟ در این مقاله پس از گزارش اجمالی ادله کلی، به قلمرو تقاص از جمله شمول و عدم شمول آن در اموال دولتی و عمومی و شرایط آن پرداخته می‌شود، با این توجه که هر چند از نگاه حقوقی میان اموال دولتی و عمومی فرق است، اما در این بحث با توجه به وحدت ملاک حکمی یکسان دارد و ازاین‌رو در کنار هم آمده است. پس از آن با توجه به ملاحظات چندی که در گسترش جواز تقاص به نظر می‌رسد، نشان داده می‌شود که تقاص هر چند اجمالاً و صرف نظر از تفصیل‌هایی که در آن وجود دارد، راهی برای جلوگیری از تضییع حقوق و استیفای آن است، اما نمی‌توان آن را راهکار فراگیر و طبیعی و جایگزین راهکار عقلایی و عمومی رجوع به دادگاه شمرد.  }, keywords_fa = {اموال دولتی,اموال عمومی,تقاص,اختلال نظام}, url = {https://jf.isca.ac.ir/article_21887.html}, eprint = {https://jf.isca.ac.ir/article_21887_b553f15f3f012a7d31ddb2f0f3483918.pdf} }
